Terms of Service
Welcome to Cars Dey. These Terms of Service govern your access to and use of our car rental marketplace platform. By using Cars Dey, you agree to be bound by these terms. Please read them carefully before booking a vehicle.
1.Agreement to Terms
By accessing or using the Cars Dey platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms apply to all users, including Customers who rent vehicles and Vendors who list vehicles for rent.
2.Description of Service
Cars Dey is a car rental marketplace that connects vehicle owners and rental companies ("Vendors") with individuals seeking to rent vehicles ("Customers").
Important: Cars Dey does not own or operate any rental vehicles and acts solely as an intermediary platform. When you book a vehicle, you enter into a rental agreement directly with the Vendor, not with Cars Dey.
3.User Accounts
3.1Account Creation
To use certain features of the Platform, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as necessary
- Keep your login credentials confidential
- Accept responsibility for all activity under your account
3.2Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other security breach.
4.Booking and Payments
4.1Booking Process
When you make a booking through the Platform, you enter into a rental agreement directly with the Vendor. Cars Dey facilitates this transaction but is not a party to the rental agreement.
4.2Platform Fees
Cars Dey charges a platform fee of ₵50 per day per vehicle for all bookings. This fee is included in your total booking cost and covers:
- Platform access and booking facilitation
- 24/7 customer support
- Booking guarantee protection
- Secure payment processing
4.3Payment Methods
Payment is due at the time of booking unless otherwise specified. We accept the following payment methods:
- Mobile Money (MTN, Vodafone, AirtelTigo)
- Credit and debit cards (Visa, Mastercard)
- Bank transfers
- Cash payments for certain booking components
5.Cancellations and Refunds
5.1Customer Cancellations
Our cancellation policy is designed to be fair to both Customers and Vendors:
- More than 24 hours before pickup: Full refund minus any transaction fees
- Less than 24 hours before pickup: May be subject to a cancellation fee determined by the Vendor
- No-show: No refund unless agreed with Vendor
5.2Vendor Cancellations
If a Vendor cancels a confirmed booking, you will receive a full refund of all payments made. We may also provide additional assistance in finding an alternative vehicle at no extra cost.
6.User Responsibilities
6.1Customer Responsibilities
As a Customer using Cars Dey, you agree to:
- Possess a valid driver's license recognized in Ghana
- Be at least 21 years of age (25 for certain vehicle categories)
- Return the vehicle in the same condition as received
- Follow all traffic laws and regulations
- Not use the vehicle for illegal purposes
- Report any accidents or damage immediately
- Not smoke in rental vehicles unless explicitly permitted
6.2Vendor Responsibilities
As a Vendor on Cars Dey, you agree to:
- Maintain valid business registration and licensing
- Ensure all vehicles are properly insured
- Provide accurate and up-to-date vehicle information
- Respond to booking requests promptly
- Maintain vehicles in safe, roadworthy condition
- Honor confirmed bookings
- Treat all Customers with respect and professionalism
7.Insurance and Liability
All vehicles listed on the Platform must have valid third-party liability insurance as required by Ghanaian law. Additional coverage options may be offered by individual Vendors.
Disclaimer: Cars Dey is not responsible for any damages, injuries, or losses arising from the use of rental vehicles. The rental relationship is between the Customer and the Vendor.
8.Dispute Resolution
In the event of a dispute between a Customer and a Vendor:
- Parties should first attempt to resolve the issue directly through communication
- If direct resolution is not possible, either party may file a claim through Cars Dey's dispute resolution process
- Cars Dey will review the claim and make a determination based on available evidence
- Both parties agree to cooperate fully with any investigation
Cars Dey's decision in disputes is final, except where local law provides otherwise.
9.Intellectual Property
The Platform and its original content, features, and functionality are owned by Cars Dey and are protected by copyright, trademark, and other intellectual property laws of Ghana and international conventions.
You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our express written permission.
10.Limitation of Liability
To the maximum extent permitted by law, Cars Dey shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages arising from your use of the Platform
- Damages arising from any rental transaction between Customers and Vendors
Our total liability for any claim shall not exceed the fees paid by you to Cars Dey in the 12 months preceding the claim.
11.Modifications to Terms
We reserve the right to modify these Terms at any time. When we make significant changes:
- We will notify you via email or through the Platform
- We will update the "Last updated" date at the top of this page
- Changes take effect 30 days after notification for existing users
Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
12.Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.
Any legal action arising from these Terms or your use of the Platform shall be brought exclusively in the courts located in Accra, Ghana.
